Terms of delivery of Tulikivi Shop

A listed family company, Tulikivi Corporation and its subsidiaries form the Tulikivi Group, the world’s largest manufacturer of heat-retaining fireplaces. The Group is known for its Tulikivi soapstone fireplaces and natural stone products as well as its Kermansavi ceramic fireplaces and utility ceramics. The Group’s revenue amounts to about EUR 67 million, about half of which is accounted for by exports. The Group owns six production plants and employs about 500 people.

The following terms shall be applied to the relationship between Tulikivi and its customers in all transactions conducted via the Internet. Tulikivi shall sell the products available at any given time in its selection to persons who have reached the age of maturity, and to companies and entities.

1 Registration

1.1 To ensure that Tulikivi can fulfil its commitments under these terms, the customer shall notify his/her name, email address, phone number and address when ordering. The customer is liable for the information’s authenticity. If the customer so wishes, he/she can also register as a customer of the online shop.

1.2 The customer undertakes to abide by these terms for each order.

1.3 Tulikivi’s customer information is confidential. Tulikivi undertakes not to transfer customer information to any other than partners within the Tulikivi Group or otherwise than within the limits permitted by law. No information shall be transferred outside Finland’s borders. The customer is entitled, under the Personal Information Act, to check his/her information in the register. The register’s purpose is to maintain/develop customer and trading relationships. The registered information comprises the customer’s name, address, phone number and email address. 2 Prices

2.1 The valid price is the price in Tulikivi’s price list at www.tulikivishop.com at the time of ordering. All prices include 22% VAT. (Tulikivi reserves the right to correct prices stated erroneously due to technical reasons. If a correction affects a placed order, the order will not be handled prior to the customer accepting the corrected order.)

2.2 Delivery expenses (EUR 15.00 per delivery for EU countries) shall be added to all orders delivered by post.

3 Payment terms

3.1 Tulikivi accepts VISA and Mastercard/Eurocards credit cards. Payment shall be made and credit card information shall be given on the protected Internet pages of financial institutions. Tulikivi shall not, at any stage, record credit card information. The customer’s card information will thus remain secret.

4 Orders

4.1 Orders can be placed via the Internet at www.tulikivishop.com.

4.2 Contacts will be made primarily by email. The customer undertakes to check his/her email for Tulikivi’s messages after making an order.

4.3 Tulikivi shall not be responsible for user IDs or passwords. If the customer forgets his/her user ID or password, he/she must register again.

5 Delivery

5.1 The delivery time for Tulikivi’s products is about 2 weeks. Please note that these times will be extended by the time required for postal delivery, which the seller cannot influence. Orders will be delivered to a post office.

5.2 If the delivery time is substantially longer, Tulikivi will aim to immediately notify the customer of this by email. The customer shall be entitled to cancel an order for a very late product by email. Tulikivi reserves the right to cancel the order, if the ordered product is sold out, or its availability is affected by other insurmountable difficulties.

5.3 If the order comprises several products and their delivery times vary, the order will normally be sent only when all of the ordered products are ready for delivery. However, the delivery can be divided into two or more lots at the discretion of the customer service. If products are delivered to the customer by post, then the postal expenses will be charged only at the time of the first part-delivery.

5.4 Orders will be delivered only to EU countries.

6 Right of return

6.1 The customer shall be entitled to return his/her ordered and normally available products within 14 days of receiving them, provided the products are unused and saleable. Enclosed with the returned products must be a copy of the covering letter and return form on which the customer shall record his/her name, contact information and order number. Tulikivi shall return the paid product price to the customer’s notified bank account upon receiving the returned products. The customer shall enclose with the returned products the name of his/her bank and his/her account number.

Tulikivi shall also recompense the customer for postal charges levied on the returned products. Note! The receipt for these postal charges must be enclosed with the returned products. The returned products shall preferably be in the original package in which they arrived. Packaging must be done carefully to avoid the returned products being damaged during postal handling.

7 Complaints

7.1 If the wrong product has been delivered to the customer, or if the product is faulty or damaged, the customer shall immediately notify the error to Tulikivi by sending an email to sales.kermansavi@tulikivi.fi. A product error is normally compensated by delivering a flawless product in its place. If this is impossible, a price discount or cancellation of the transaction may be considered.

8 Force majeure

8.1 Tulikivi shall not be liable for the delivery of an order being prevented, complicated or delayed due to a ‘force majeure’ outside Tulikivi’s influence, such as war, natural catastrophe, export and import bans, governmental decisions, interruptions to public transportation or power networks, labour conflicts or other corresponding forces complicating or preventing the operations of Tulikivi or its suppliers.

9 Settlement of disputes

9.1 Finnish law will be applied to disputes and differences of opinion arising from this agreement.

10.1 All enquiries about orders, returns, deliveries and invoicing shall be sent by email to sales.kermansavi@tulikivi.fi.
